Hi,
ich habe folgende situation:
ich habe ein medikament erfunden, das aus teil a und b besteht.
leider gibt es für teil a schon ein patent, so dass ich nur b an sich und eine kombi aus a und b anmelden konnte, und dafür aber auf den patentinhaber für teil a angewiesen bin.
glücklicherweise habe ich eine veröffntlichung gefunden, die mit 80%+ wahrscheinlichkeit das patent für a kippen kann.
ich habe noch rechtzeitig einspruch erhoben, möchte aber das patent nicht unbedingt kippen wenn es nicht sein muss. eine kostenlose lizenz würde mir reichen, dann könnte ich mein medikament a+b machen und der andere könnte sein patent behalten.
wenn der andere nicht darauf eingeht, muss ich das patent halt kippen, und damit leben, dass dann jeder ein medikament mit a machen kann, und hoffen, dass mein teil b so viel verbesserung bringt, dass ich mich ordentlich von der menge abheben kann.
die große frage ist, wie bringe ich die gegenseite überhaupt dazu mit mir zu sprechen und zu verhandeln?
ich habe mal was aufgesetzt, vielleicht hat ja einer mal bissel zeit da drüberzukucken und einen kommentar abzugeben.

It is now X weeks since I sent you the copy of my notice of opposition and the information where you can download the cited documents. A few days later you should have received the complete documents from the European Patent Agency.
I think these X weeks should have been enough to analyse the opposition and to estimate how relevant it is for the patent of your client.
You will have noticed that the cited documents are very relevant for the novelty and inventive action of the patent, and that there is a high probability that the patent is going to be withdrawn. And in the bare possibility of the patent not being withdrawn, the claims will have to be restricted very much so the patent will loose most of its value.
At the very least you will loose the application for XXXXXXXXX diseases because of the publication of XXXXX at al.
I summarised the consequences of two scenarios below:
Opposition pursued, patent withdrawn

Even if I would have to pursue the opposition and you would keep the claim for the application on XXXXXXXX diseases, I could easily sell a composition containing XXXXX XXXX if I would sell it for the equalisation of the ZZZZZ ZZZZZ in the ZZZZZZZ.
Remember this application is not covered by your clients patent. I would just have to sell two formulations, one with the XXXXXXX XXXXXX for the equalisation of the XXXX of XXXXX XXXXX, and a second one containing the other active ingredients for the treatment of the targeted disease with the side notice that this formulation works best when the ZZZZZZ ZZZZZ are ZZZZZ.
Last week I received a letter from the European Patent Agency where the formal officer told me that I have forgotten to sign the notice of opposition.
According to my patent attorney the notice of opposition would be considered valid if I sign the notice within 2 months from the date of the notification from the formal officer.
If I would miss the deadline, the notice of opposition would be treated as if it was not have been sent in time.
So if we could get together an arrangement before that date and I let the deadline pass by, there would be no more open proceeding to your patent and it would be considered as finally granted.
Please inform your clients about the present situation, and if they would like to avoid withdrawal of their patent, contact me soon to enter into negotiations about a corresponding agreement.
